Terms of Service
By using Kandy — the dashboard, the Discord bot, or any related services — you agree to be bound by these terms. Please read them carefully.
Last updated: 29 May 2026
Acceptance of Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and the operators of Kandy ("Kandy", "we", "us", "our") governing your access to and use of:
- The Kandy web dashboard hosted at any domain we operate under.
- The Kandy Discord bot added to any Discord server ("guild").
- Any APIs, webhooks, or integrations provided by Kandy.
By logging in, adding the bot to your server, or otherwise accessing Kandy in any form, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately stop using the service.
Use of Kandy is also subject to Discord's own Terms of Service and Community Guidelines. You are responsible for ensuring your use of Kandy does not violate Discord's policies.
Eligibility
You must be at least 13 years old to use Kandy, in accordance with Discord's minimum age requirement. If you are between 13 and 18 years old, you represent that you have obtained parental or guardian consent to use the service.
By using Kandy, you represent that you have the legal authority to enter into these Terms on behalf of yourself or the organisation you represent. If you are configuring Kandy for a Discord server, you represent that you have the necessary permissions ("Manage Server") on that server.
The Service — What Kandy Does
Kandy provides Discord server management utilities, including but not limited to:
- Heist & Mafia Ad Automation: Automatically sending coordinated advertisement messages to configured partner channels on a schedule.
- Partnership Management: Facilitating server-to-server partnership offers, tracking status, and storing partnership metadata in our database.
- Reach Analytics: Calculating estimated advertising reach by sampling role membership across partner servers.
- Mafia Game Logging: Optionally recording Mafia Discord game events to a designated log channel via the dashboard.
- Developer Inbox: Delivering broadcast messages from the Kandy team to dashboard users and bot users in their connected Discord servers.
We reserve the right to modify, suspend, or discontinue any feature of the service at any time with or without notice. We will make reasonable efforts to notify users of material changes.
User Accounts & Authentication
Kandy uses Discord OAuth2 for authentication. You do not create a password directly with us; your identity is verified through your Discord account. You are responsible for maintaining the security of your Discord account and any access tokens.
You may not share your dashboard session or allow third parties to use your authenticated session. If you suspect unauthorised access, you should immediately revoke Kandy's OAuth authorisation through your Discord account settings.
We reserve the right to suspend or terminate your access if we detect abuse, fraud, or violation of these Terms. Account bans may be applied at the user or server level at our sole discretion.
Permitted Use
You agree to use Kandy only for lawful purposes and in ways that do not:
- Violate any applicable local, national, or international law or regulation.
- Violate Discord's Terms of Service or Community Guidelines.
- Send spam, unsolicited advertising, or advertisements to channels or servers that have not explicitly agreed to receive them (i.e., only use Kandy with confirmed partner channels).
- Harass, threaten, or harm other users, server members, or third parties.
- Attempt to gain unauthorised access to other users' servers, data, or the Kandy infrastructure.
- Reverse-engineer, decompile, or scrape any part of the Kandy service.
- Use the service to advertise illegal content, NSFW content in minors' servers, or content prohibited by Discord.
- Manipulate bot statistics, reach counts, or any data displayed on the dashboard.
Kandy may provide client-side migration tools, browser bookmarklets, or scripts to facilitate importing your configuration or partnership data from other platforms. If you choose to use these tools:
- You represent and warrant that you possess the legal right, ownership, or authorized access to the data you are exporting from the source platform.
- You agree that you are solely responsible for ensuring your use of such tools complies with the terms of service, policies, and guidelines of any relevant third-party platform.
- You acknowledge that Kandy provides these tools purely for your convenience. Kandy is not affiliated with, endorsed by, or in any way officially associated with any third-party bot, service, or platform from which you migrate data (including, but not limited to, Shero Bot).
- Kandy accepts no liability or responsibility if your server, guild, or Discord account is suspended, banned, or otherwise penalized by a third-party service as a result of using migration scripts.
Premium Features
Kandy may offer premium features or tiers in the future. If and when paid features are introduced:
- Pricing, billing cycles, and feature entitlements will be stated clearly at point of purchase.
- Payments are non-refundable unless required by applicable consumer protection law or explicitly stated otherwise at the time of purchase.
- We reserve the right to change premium pricing or feature access with at least 14 days' advance notice to affected users.
- Abuse of premium features (e.g., chargebacks without valid basis, account sharing) may result in permanent suspension without refund.
Currently, premium features are granted manually by the Kandy team. Any premium access currently provided is at our discretion and may be revoked if misused.
Intellectual Property
All content, branding, code, designs, and materials that make up the Kandy service — including but not limited to the Kandy name, logo, dashboard interface, and bot behaviour — are owned by or licensed to the Kandy operators and are protected by intellectual property law.
You are granted a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. This licence does not include the right to copy, redistribute, resell, or create derivative works based on Kandy's materials.
Any content you submit or configure through Kandy (e.g., partnership descriptions, ad templates, server configurations) remains your intellectual property. By submitting it, you grant Kandy a licence to process and store it for the purpose of providing the service.
Disclaimer of Warranties
The Kandy service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be uninterrupted, error-free, or secure at all times.
- Advertisements will be successfully delivered to all partner channels (channel availability, bot permissions, and Discord API reliability are outside our control).
- Reach calculations or analytics are perfectly accurate — they are estimates.
- Any data stored will be retained indefinitely.
Limitation of Liability
To the maximum extent permitted by applicable law, Kandy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of partnerships or advertising revenue due to service downtime.
- Data loss caused by database failures, bot restarts, or migrations.
- Actions taken by Discord against your server as a result of using Kandy.
- Unauthorised access to your account or server data by third parties.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim. If you have not paid anything, our liability is limited to £100 GBP or the minimum required by your local law.
Indemnification
You agree to indemnify, defend, and hold harmless Kandy and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:
- Your use of or access to the service.
- Your violation of these Terms.
- Your violation of any third-party rights, including Discord's Terms of Service.
- Any content or advertisements transmitted through Kandy at your direction.
Termination
You may stop using Kandy at any time by removing the bot from your server and revoking OAuth access via your Discord settings. You may request deletion of your data by contacting us (see Section 13).
We may suspend or terminate your access at any time, with or without cause, including but not limited to violations of these Terms. Upon termination:
- Your right to use the service immediately ceases.
- We may retain your data for a reasonable period as required for legal compliance, audit, or dispute resolution purposes, after which it will be deleted.
- Provisions of these Terms that by their nature survive termination will continue to apply.
Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via the Developer Inbox system (visible on the dashboard and as an ephemeral Discord notification) and will take effect 14 days after notification unless required sooner by law.
Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the service.
Contact & Governing Law
If you have questions about these Terms, wish to report a violation, or need to contact us for any legal purpose, please reach out via our official Discord support server linked in the dashboard documentation.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Kandy operates. Any disputes shall be resolved through good-faith negotiation first; if unresolved, through binding arbitration or the competent courts of the applicable jurisdiction.
